TappyLinks Physical Products Affiliate Program Terms and Conditions

Please read these Terms and Conditions carefully before participating in the TappyLinks Physical Products Affiliate Program (the “Program”). By signing up for or participating in the Program, you agree to be bound by these Terms and Conditions.

1. Definitions

• “TappyLinks”, “we”, “us”, or “our” refers to Plus Six Solutions, the owner and operator of TappyLinks.com, a business based in Washington State, USA.
• “Affiliate”, “you”, or “your” refers to the individual or entity participating in the Program.
• “Physical Products” refers to TappyCards and any other NFC-enabled physical products offered for sale on TappyLinks.com.
• “Affiliate Link” means the unique tracking link provided to you upon acceptance into the Program.
• “Commission” means the compensation you may earn for qualifying sales.

2. Enrollment and Acceptance

• You must be at least 18 years of age and have a valid TappyLinks account to join the Program.
• To enroll, complete the affiliate signup process in your TappyLinks dashboard.
• We reserve the right to accept or reject any application at our sole discretion.
• We may require additional information (such as tax ID, payment details, or identification) before approving your account or issuing payments.

3. Affiliate Responsibilities

• You agree to promote TappyLinks Physical Products only through your approved Affiliate Links.
• All promotional activities must comply with applicable laws, including FTC endorsement and disclosure guidelines (you must clearly and conspicuously disclose your affiliate relationship).
• You are responsible for the content you create and distribute. It must be accurate, non-misleading, and professional.
• You may not use spam, unsolicited commercial emails, or any illegal or unethical marketing methods.

4. Commission Structure

• You will earn 30% commission on the net sale amount (excluding shipping, taxes, discounts, refunds, and chargebacks) from all qualifying purchases of Physical Products made through your unique Affiliate Link.
• Commissions are earned on every purchase made by referred customers (recurring and repeat purchases are eligible).
• Commissions become eligible for payout after the order has shipped and the refund/return period has expired (typically 30 days).
• We reserve the right to modify commission rates with at least 14 days’ notice.

5. Payment Terms

• Payments are processed via PayPal or bank transfer (subject to availability and your provided details).
• The minimum payout threshold is $50. Any balance below this amount will roll over to the next payment period.
• Payments are issued monthly, on or before the 15th of the month following the month in which the commissions were earned.
• You are solely responsible for all taxes on commissions received.
• We may withhold or reverse commissions for refunded, canceled, or fraudulent orders.

6. Tracking and Reporting

• Sales are tracked using cookies with a 30-day duration.
• You may access real-time statistics (clicks, sales, earnings) in your affiliate dashboard.
• In the event of any discrepancy, Plus Six Solutions’ records shall be final and binding.

7. Prohibited Activities

You agree not to:

• Use TappyLinks or Plus Six Solutions trademarks, logos, or branding without prior written permission.
• Bid on branded keywords (TappyLinks, TappyCards, etc.) in paid search advertising.
• Create any website, social profile, or content that could reasonably be confused with official TappyLinks channels.
• Engage in fraudulent, illegal, or deceptive practices.
• Promote on coupon, deal, or cashback websites unless expressly pre-approved in writing.
• Offer any unauthorized incentives or discounts.

Any violation may result in immediate termination of your affiliate account and forfeiture of all unpaid commissions.

8. Intellectual Property

• Plus Six Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use approved marketing materials and logos solely for the purpose of promoting the Program.
• All goodwill generated from your promotion belongs exclusively to Plus Six Solutions.

9. Termination

• Either party may terminate this agreement at any time, with or without cause, upon written notice.
• Upon termination, you must immediately stop using all Affiliate Links and promotional materials.
• You will only be eligible for commissions on qualifying sales made prior to the effective termination date.
• We may terminate your participation immediately for any breach and withhold commissions earned in violation of these terms.

10. Disclaimer and Limitation of Liability

• The Program is provided “as is” without any warranties, express or implied.
• Plus Six Solutions shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of your participation.
• In no event shall our total liability exceed the total commissions paid to you in the twelve (12) months preceding any claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Plus Six Solutions, its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your breach of these Terms and Conditions,
• Your promotional activities or content,
• Any violation of applicable laws or third-party rights.

12. Governing Law

These Terms and Conditions are governed by the laws of the State of Washington, USA, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Clark County, Washington, and you hereby consent to the personal jurisdiction and venue of such courts.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or through your dashboard. Your continued participation after such changes constitutes your acceptance of the revised Terms.
